Accidents At Work

If you have suffered an injury at work - whether it is major or minor - you are entitled to damages if you can show that someone else (usually your employer) was at fault. This is because most workplaces have to comply with strict rules and complicated regulations to protect the safety of their staff. So if your injury has been caused by your employer's failure to apply these regulations you will have a strong case.

Even if it was a fellow employee who caused your accident, your employer is still liable to pay the damages. Your employer has a legal responsibility to hold Employers Liability Insurance, which will cover such instances.

What should you do if you have an accident at work?

- DO make sure the accident is reported and recorded accurately in the Accident Report Book. If you are asked to sign it, make sure it is a fair and accurate account of what happened.

- DON'T allow your employers to pressure you into giving a finely detailed written statement - especially if you are still suffering from the trauma of the accident.

- DO make sure that your employers fulfil their obligation to report serious injuries to the Health & Safety Executive.

- DO make sure that your employers fulfil their obligation to report serious injuries to the Health & Safety Executive.

Road Traffic Accidents

Road accidents can leave you with injuries ranging from minor whiplash to something far more serious. Whatever the type of accident - or injury - you are legally entitled to financial compensation if someone else was the cause. For example:

- If you were the driver of a vehicle involved in an accident for which another driver was to blame.

- If you were a passenger in a vehicle involved in an accident and your driver, or the driver of the other vehicle, is at fault.
Note: don't worry if the driver is a friend or family member because they will automatically lose their no claims bonus as a result of the damage caused to the other vehicle.

- You are a pedestrian who was hit by a vehicle when crossing a road - especially at a pedestrian crossing.

- You are a cyclist who was knocked off your bike by a motorist who failed to see you.

If any of the above apply to you, contact Lawyers4you immediately

Please be aware that it is a legal requirement to report an accident to the police if someone has been injured within 24 hours of the incident.

Other Types of Accidents

Other types of accidents and injuries that may result in you being able to make a claim could involve leisure or sporting activities. As a rule of thumb, if you can show that your accident could have been prevented and was someone else's fault, then you probably have good grounds to claim. For example:

1. You can't claim if you injured yourself through your own act of recklessness while skiing. But you can claim if the skiing accident was caused by faulty equipment that you had rented, or because another skier crashed into to you.

2. You can't claim if you injured yourself as a result of normal contact in a game of 5-a-side football. But you can make a claim against the owner of the sports hall if your accident was the result of being injured by something protruding from a wall that shouldn't have been there.

Every case is different so it is essential that you contact Lawyers4you immediately for expert advice. It's free and you may be surprised to find that you do have a claim!
